He was Not asked to see the patient. Dr. Blum admitted in

writing that he was Never asked to see the old woman.

Dr. Blum sent a bill or charges to the patient for his unwanted,

unsolicited and unrequested medical services.

the patient refused to pay.

Question :

Why was the investigation of Dr. Lino Dial illegal and fraud ?


Evidence :

The most glaring and conspicuous evidence that the

investigation of Dr. Lino Dial was illegal and a fraud is that

the Hospital supposedly had or received reports of the so - called

investigation.

The Hospital and Medical Staff told lies , deceits , falsehoods

and frauds during the Judicial Hearing about the investigation

of Dr. Lino Dial .

The physicians and Doctors supposedly made reports of the

investigations.

These are recorded in the 100 - page transcript of the Judicial

Hearing .


Question :


How could a patient be admitted to the Hospital , and a Doctor

make a report that he or she investigated the patient when that

same patient was in the Cemetery and had been dead for a year ?

This is similar to a dead voter.

The patient was Not even at the Hospital at the time of the

investigation .

The reports of these Doctors are frauds or false .

The investigation was fraud and illegal .

True Story.

1. John Corapi was a healthy white male, single, about fifty years
old, who went to a doctor for a routine medical check up .

2. He knew that he was healthy, was doing regular exercises, had
no aches or pains, active in sports, served in the US Army , etc.

3. Feeling healthy and being told he needed surgery arouse suspicion.

4. Please tell the Doctor to write down the problem or Diagnosis.
Ask him what kind of surgery is to be done and how that will help
his medical condition.

5. Tell him that your neighbor is a doctor , arriving from Manila or
Melbourne today and will ask him a few things.

6. Also you and your wife or husband will discuss the surgery matter.

7. That is what John Corapi and another patient , Joseph Zerga did.
They got second opinion, found out they were both healthy.

8. Both John Corapi and Joseph Zerga filed lawsuit.

9. The doctors, Redding Medical Center in Redding, California and
their health insurance paid about sixty million dollars in damages.
The hospital changed its name to Shasta Regional Medical Center
located at 1100 Butte Street, Redding, CA 96001.

10. The unnecessary surgeries are now forgotten.

The investigation of Dr. Lino Dial .

Dr. Lino Dial was placed on investigation or monitoring program
for a period of six months ( per hospital document submitted and
accepted as evidence during the Judicial Hearing ) .

It is important to point out that if a Hospital and Medical Staff
will investigate any doctor , it must be done fairly and without
bias or prejudice .

The following pages in the transcript show that there was bias
and prejudice or unfair investigation of Dr. Lino Dial .

At this time I submitted a list of my patients who were admitted

to the hospital during the six month period of monitoring and

investigation of Dr. Dial .

There are sixteen ( 16 ) patients who were Not reviewed .

Each patient is given a count of one ( 1 ) .

Five ( 5 ) plus sixteen ( 16 ) make ( 21 ) times that the hospital

Attorney , Mr. Schnier told lies , deceits and falsehoods during the

Judicial Hearing , a legal proceeding . This was proven by

the transcript of that hearing .

Mr. Steven V. Schnier, ESQ , the hospital attorney , is an officer

of the Law , a Public Officer , or a Peace Officer .

Government code section 1031 , subdivision ( b ) provides that each

Public Officer or Peace Officer shall " be of Good Moral character ....".

( comment of Dr. Dial : What about telling lies or falsehoods ? ) .


More evidence of Lies and Deceits :

Page 8 Lines 24 -- 25 :

The hospital attorney says that he reviewed monitoring reports on

ALL patients admitted by Dr. Lino Dial during the six months of

monitoring period .

I submitted the evidence that sixteen ( 16 ) patients , with names ,

Hospital room and bed numbers Were NOT Reviewed during the six

months period of investigation of Dr. Lino Dial .

It stands to reason that if the sixteen ( 16 ) of my patients Were

NOT reviewed then there were NO Monitoring Reports .

That gives another sixteen ( 16 ) counts of frauds in addition

to the twenty - one ( 21 ) .

Sixteen ( 16 ) lies plus Twenty - one ( 21 ) frauds make a total of

Thirty - seven ( 37 ) falsehoods .

The Physicians who produced the monitoring reports on the

sixteen ( 16 ) patients added another sixteen ( 16 ) lies and frauds .

Thirty - seven ( 37 ) plus sixteen ( 16 ) make a total of

Fifty - three ( 53 ) lies , deceits and frauds committed by lawyer and

Physicians during the legal proceeding .

Dr. Peter E. Philbin , M.D. is a California - licensed
practicing Physician. His specialty is Internal Medicine.
He is a Nephrologist .

Dr. Philbin accused Dr. Dial of not getting a
Cardiology consultation on a patient . This accusation
was made under oath , on the witness stand , during
the Judicial Hearing .

Recall that the hospital claimed in writing ( I have
many copies ) that the Judicial Hearing did not take
place .

Their reasoning appears to be :

No Hearing , No Transcript , and No crimes committed.

In the transcript ( I have many copies ) :

Page 43 Lines 20 -- 21 : Dr. Dial should have ordered
Cardiology Consultation .

Page 46 Lines 14 -- 23 : The patient was seen by a
Cardiologist , Dr. Hyman Paley
of San Francisco , California.

Page 47 Lines 8 -- 9 : A Cardiologist did see the
patient ( said Dr. Johnson , a
member of panel of six doctors).

Page 48 Lines 10 -- 12 : Dr. Johnson asked :
He's a Cardiologist ?

Page 48 Lines 11 -- 12 : Dr. Lino Dial says : Yes ,
Dr. Paley is a Cardiologist .

The accusation presented by Dr. Peter E. Philbin

was proven false beyond any doubt by the Hospital

medical record .


Question :

Why did the Hospital and Medical Staff make

false accusations against me many times ?

Dr. Leonard Brant , M.D. is a California - licensed
practicing Physician . His specialty is Surgery . He is
a Urologist .

Dr. Brant accused Dr. Dial of making a wrong

interpretation of an Electrocardiogram ( EKG ) of a

patient .

The evidence is in transcript of the Judicial Hearing.

Page 84 Lines 23 -- 25 : Somebody specifically said
misinterpretation of cardiogram.

Page 84 Line 26 : Dr. Brant , the witness , says : Yes .
( Dr. Brant was under oath. ).

( When the hospital medical record
was examined , Dr. Dial DID NOT
read the Electrocardiogram ) .

Page 85 Lines 11 -- 13 : Dr. Brant , the witness , says :

I don't see any evidence here

that Dr. Dial made an interpre-

tation of the EKG .

Page 81 Lines 15 -- 16 : Dr. Johnson asked :

Who read the Cardiogram ?

Page 81 Lines 17 -- 18 : Dr. Brant says :

Dr. Diamondstone . Two EKGs

were both read by Dr. Diamondstone .

The official written accusation against Dr. Lino Dial ,

made by Dr. Leonard Brant , on the witness stand ,

while under oath , was proven false , without a doubt ,

by the hospital patient medical record .

11. Hospital Falsification No. 11.

The result of the investigation of the Hospital practice of medicine of Dr. Lino Dial was discussed at
the Judicial Hearing. The investigation was full of lies,
deceits and falsehoods.

On page 14 Lines 24 -- 25 of the transcript of the
same Judicial Hearing , the chairman of the panel of
six physicians, Dr. Edwin Bradley of Fairfield , CA
told the Hospital Attorney, Mr. Steven V. Schnier , that
we have a patient here who was hospitalized a year
before the investigation.

On page 15 Line 26 , the hospital attorney said yes.
This is another confirmation that the hospital attorney
told lies , deceits and falsehoods.

The investigation was a fraud . The patient was not
in the hospital during the investigation .

The Doctor's report is a fraud . How could the
Doctor investigate the patient in the hospital when the
patient was not there ?


Question :

When will they stop telling lies and falsehoods ?

Here are two more instances of frauds during the
so - called investigation Dr. Dial at the hospital.

On page 24 Lines 18 --- 19 , the hospital presented
another investigation of a patient of Dr. Lino Dial.

Again , this patient was also hospitalized one year
before the so - called investigation or monitoring of the
hospital medical practice of Dr. Lino Dial .

The investigation was a fraud .
The investigation or monitoring report is fraud.
The Doctor's report is fraud.


Question :

How could anyone make a report of an

investigation when the patient was not even in the

hospital during the so - called investigation ?


13. Hospital Falsification No. 13.

Here are evidences of lies , deceits and falsehoods
committed by the Hospital and Medical Staff during
the investigation of the hospital medical practice of
Dr. Lino Dial.

On page 41 Line 13 , the hospitalization of the
patient was described.

On page 41 Line 21 , the patient is said to be
a hundred ( 100 ) years old .

On page 41 Lines 15 -- 16 , it was read that this

patient was hospitalized outside the investigation period.

Therefore , any report about this patient is fraud.

The Physician who made a report committed fraud also.


Question :

Should Attorneys know when frauds are committed ?

On page 60 Lines 21 -- 22 of the transcript of the
same Judicial Hearing the situation was the same.

Supposedly , I admitted a patient to the Hospital during
the monitoring or investigation period.

A Physician investigated the patient and the Hospital
Attorney received a report of the investigation . Again ,
there are two instances of frauds here .

The investigation was a fraud because the patient was

dead before the investigation . The report made by the

the Doctor was also a fraud.


Question :

How many times do we allow a Hospital , Medical Staff

and their Attorney to tell lies and falsehoods during

a Legal proceeding ?


10. Hospital Falsification No. 10.

The lies , deceits and frauds made against me were
documented and recorded in the transcript.

No wonder after the hearing , the Hospital claimed in
writing that the hearing never took place.

They don't want anybody to see what is in the transcript. I am not yet finished . There are many more
falsities and falsehoods.

On page 61 Lines 6 -- 9 of the transcript ,
Dr. Edwin Bradley, M.D. the chairman of a panel of six
Physicians who were there at the hearing like a jury to
judge me , said :

" We talked about a monitoring or investigation period.
This case was in the hospital and died a year before
the investigation and yet you ( referring to Hospital
Attorney ) speak of monitoring reports . "

This is a confirmation of the falsehood of the preceding
statements.

6. Hospital Falsification No. 6.

Attorneys are officers of the Law. In a Judicial Hearing
they are supposed to tell the truth like everybody else.

During the Judicial Hearing , the Hospital Attorney,
Mr. Steven V. Schnier, ESQ. of San Francisco, CA was
caught telling a lie , or deceit or fraud , at least three
times. This is in the transcript of that same Judicial
Hearing.

The first time that the Hospital Attorney told a lie
or a falsity is on page 8 Line 26 of the transcript.
I asked the hospital Lawyer whether he asked for report for monitoring or investigation of my patients.
The Hospital Attorney answered yes.

The reason the Hospital Attorney's answer is a lie
or a fraud is that the patient was ALREADY DEAD
for a year during the so - called investigation.

Question :

How can anyone admit a patient to the Hospital ,

investigate the patient , and have a report when the

patient was already dead before the investigation ?

In the transcript of the Judicial Hearing , the Hospital Attorney told a lie or falsehood for the first
time on page 8 Line 26 after I asked him whether
he received monitoring reports and he answered yes.

It was not possible to have a monitoring or
investigation report because the patient was dead
before the investigation.

The Hospital Attorney told a lie or a fraud a second time , recorded in the transcript , is on
page 9 line 3. He answered yes after I asked him
whether the Doctor who investigated my patient
submitted a report. This is a lie and a falsity for
the same reason.


Question :

How can a Physician investigate and make a report

on a patient who died a year before the investigation ?


8. Hospital Falsification No. 8.

The Hospital Attorney told lies , deceits and falsities
for the first , second , and third time in this section.
He told many more lies and falsehoods.

A hospital document was submitted and accepted as
evidence during the hearing. It stated that the Hospital
will investigate hospitalized or in - patient hospital patients of Dr. Lino Dial during a six month period.

The first time that the Hospital Attorney told lies ,
deceits and falsehoods , there were actually two counts
or instances of frauds : The first is that he said he
received a report. The second is that the investigating
Physician made a report.

These are frauds because the patient was in the Cemetery and has been dead for a while during the investigation.

The second time that the Hospital Attorney told lies
and deceits , there were two counts or instances of
frauds also.

The third time that the Hospital Attorney told lies
and deceits is on page 56 Lines 16 -- 17 of the
transcript of the same Judicial Hearing.

This is another patient who died , was buried in
the cemetery while the Hospital and the Hospital Lawyer
claim that the same patient was sick and supposedly I admitted him to the hospital and they
even have reports of their investigations .


Question :

How could I admit a patient to the hospital

and for any Doctor to investigate him when he was

already dead before the investigation ?


9. Hospital Falsification No. 9.

On page 60 Lines 21 -- 22 of the transcript of
the same Judicial Hearing the situation was the same.

Supposedly , I admitted a patient to the Hospital
during the monitoring or investigation period , a
Physician investigated the case and the Hospital
Attorney received a report of the investigation.
Again , there are two instances of frauds here .

2. Hospital Falsification No. 2.

Background :

Dr. Robert S. Blum falsified the Hospital medical record of an old woman. The patient was not his. The Physician
in charge of the patient was Dr. Lino Dial.

The Hospital and Medical Staff covered - up the illegal
and unethical actions of Dr. Blum. The hospital investigated Dr. Lino Dial instead of Dr. Blum who falsified the hospital record.

False accusations or fabricated charges were made in writing against Dr. Dial.

Conclusion of the investigation of Dr. Dial :

That Dr. Lino Dial is a bad doctor and his Hospital privileges should be removed.

They forgot to mention that they told lies , deceits , and
falsehoods during a Judicial Hearing.

According to the Hospital by - laws, Dr. Dial was entitled
to a Judicial Review Hearing. Judicial Review was requested by Dr. Dial and granted by the Hospital.

Question :

Why did the Hospital make false accusations against

Dr. Dial ?

The preparation for the Judicial Review Hearing took about six months. The same false accusations or fabricated
charges were made against Dr. Lino Dial. These false
accusations were already proven to be false during the
investigations of Dr. Lino Dial.

The evidence that proved them wrong or false were the
hospital patient medical records.

This time these were submitted as official written charges against Dr. Dial. The evidences were the same.
Conclusion was the same.

This time the same accusations or charges were made
during a Judicial Hearing , a Legal Proceeding and testimony is under oath on the witness stand.

Question :

Why would the Hospital and Medical Staff

accuse me ( I am Dr. Lino Dial ) of the same charges

that were already proven false ?

( They convicted themselves ) !


4. Hospital Falsification No. 4.

The Judicial Review Hearing was held according to the
laws of California. It was a legal proceeding.

There were ten persons present during the hearing. The
official court transcriber produced a hundred - page
transcript of the hearing. The entire hearing was about me. I was present at the hearing.

After the hearing , the Hospital claimed in writing that the hearing never took place and that it was canceled.

Question :

Why would the Hospital and Medical Staff declare that

the Judicial Review did not take place ?

5. Hospital Falsification No. 5.

It is undeniable and incontestable that the Judicial
Review Hearing , a legal proceeding was held according
to law. The evidences that it was held :

Ten persons were present at the hearing.

The official court transcriber produced a hundred pages
of transcript of the hearing.

I presented the 100 - page transcript of the hearing to
the Medical Board of California.

The reason given by the Hospital ( in writing ) that the
Judicial Review Hearing did not take place is that
Dr. Lino Dial canceled it.

This is a lie , a fraud and a falsehood because I was
present at the hearing.

How could I cancel the Judicial Hearing which I attended ?
