THE CRIMES COMMITTED BY ATTORNEY STEVEN V. SCHNIER OF SAN FRANCISCO, CALIFORNIA.


1.  In the One - Page  Summary  No.  15 , on  Page  8  lines  7 - 23  of the transcript of the  Judicial Review Hearing :
     The Monitoring Program ( Hospital investigation of Dr. Lino Dial ) was instituted by the Medical Staff Executive Committee to last for six months.
In other words, they made the rule that patients I admitted to the Hospital during those six months will be monitored or examined or investigated.
     This statement in the Judicial Review Hearing transcript established the " playing field " , so to speak.  The " Ball Park " or location was agreed upon, for example , " Michigan ".


2.  When the Hospital , the Medical Staff and their attorney, Mr. Schnier presented several patients who were not hospitalized during the six months period of hospital monitoring or investigation , in effect,  they did not want to follow their own rule.
     They established the " playing field " or the " Ball Park " was going to be " Michigan ".  When the time came to play the game, they decided to play in " Madrid " or " Manila ".     That  is  most  unfair.
    
 Examples :


1.  The crimes of Fraud  No. 1 , No. 2 , and No. 3  were about a patient who was dead for  a year before the monitoring began.


2.  The crimes of Fraud  No. 4 , No. 5, and No. 6 were about a similar patient.


3.  The crimes of Fraud  No. 7 , No. 8, and No. 9  were about a patient who was not hospitalized during the monitoring period.  In the game of sports,  they were outside the " playing field " or the " Ball Park ".


     In every patient presented who was not hospitalized during the monitoring period,  three crimes of fraud were committed.  These include:


1.  No hospitalization during the monitoring period.
2.  No hospital monitoring or examination by doctors who supposedly monitored me during the six months period.
3.  No hospital monitoring medical report.


     These are intentional deceptions and misrepresentation of facts on the part of the Hospital and the Medical Staff.


The evidence :


     Page  8  lines  24 - 26 of the transcript of the Judicial Hearing :
Mr. Schnier asked for and received hospital monitoring reports from the doctors who monitored me.  But these patients were not even in the hospital.


Crimes of Fraud  No.  10 ,  No.  11 ,  and  No.  12 .

Page  17  lines  9 and 10 :  Mr. Schnier and the Hospital witness, Dr. Philbin , presented and discussed a patient who was hospitalized  one year before the hospital monitoring began.
     This is another false representation of facts or perversion of truth because the patient was not hospitalized during the monitoring period.
     The hospital , the Medical Staff , attorney Schnier and the hospital witness, Dr. Philbin, were playing outside the " Ball Park ".
This  is  most  unfair.
