2. What is Prosecution ?
In Criminal Law :

of law, before a competent tribunal, for the purpose of determining the
guilt or innocence of a person ( or institution like Sutter - Solano Medical

4. Sigsbee v. State , 43 Fla. 524 , 30 South. 816.
By an extension of its meaning " Prosecution " is sometimes used to
designate the State as the party proceeding in a criminal action , or the
prosecutor or counsel.
3. What is criminal case ?
An action or suit or cause instituted to punish an infraction of the
criminal laws.
Examples :
1. State v. Smalls. 11 S.C. 279.
2. U.S. v. Three Tons of Coal , 28 Fed. cas. 149.
4. What is Civil and Criminal ?
The term " civil " is used to designate a conspiracy which will furnish
ground for civil action , as where , in carrying out the design of the
conspirators ( in this case : Sutter - Solano Medical Center, formerly
Vallejo General Hospital and its Medical Staff and the California Medical
Board ) , overt acts are done causing legal damage, the person injured
has a right of action. It is said that the gist of a civil conspiracy is the
injury or damage. While criminal conspiracy does not require such overt
acts, yet , so far as the rights and remedies are concerned , all criminal
conspiracies are embraced within the civil conspiracies.
Example :
Brown v. Pharmacy Co., 115 Ga 429, 41 S.E. 553 , 57 L. It. A.
547 , 90 Am. St. Rep. 126.
To be continued.
The end for now.
