ENUMERATION OF THE 53 CRIMES.
1. In
the One – Page Summary No. 2 I presented the definition of Fraud which
include Wrongful Criminal Deception , Misrepresentation of facts , Willful
Deliberate Intentional Deception and
Perversion
of Truth.
2. In
the One – Page Summary No. 19 , I pointed out that in every patient
presented by Attorney Schnier during the Judicial Review Hearing, those that
were not hospitalized during the monitoring period contained at least three
counts of frauds or Intentional willful deliberate misrepresentation of facts.
3. The first three counts of frauds involved
the patient who had been dead for a year before the Hospital investigation or
monitoring began. This patient was
described on page 56 of
the transcript of that Judicial Review Hearing.
4. The crimes of fraud No. 4
, 5 , and 6 involved a similar patient describes on pages
59 , 60, 61 of the transcript of that Judicial Review Hearing.
5. The crimes of fraud No. 7
, 8 , and 9 is about a patient described on
pages 14 and 15 of the transcript
of that Judicial Review Hearing.
6. The crimes of fraud No. 10
, 11 and 12 is about a patient described on page 24 of the transcript of that Judicial Review
Hearing. This one was not hospitalized during the
hospital investigation.
7. The crimes of fraud Nos.
13 , 14 , and 15 is about a hundred year old patient who was not hospitalized
during the hospital investigation. This
located on pages 41 and
42 of the transcript of that Judicial Review Hearing.
8. The crime of fraud or intentional
misrepresentation of fact No. 16 is
found on page 43 lines
20 , 21 , and 22. The charge against Dr. Lino Dial :
“ Dr. Dial should have ordered Cardiology Consultation .” The evidence that the charge or accusation
against Dr. Dial is false is on

EVIDENCE
: TRANSCRIPT OF THE JUDICIAL REVIEW
HEARING.
1. In
the One – Page Summary No. 21
, the last count of crime was
No. 18.
2. Crime
No. 19 is Perjury.
While under oath on the witness stand , during the Judicial Review
Hearing , Dr. Peter E. Philbin accused
me of not getting a Cardiology Consultation.
The accusation or charge against me is on page
43 lines 20 – 21.
The accusation or charge was proven false beyond any reasonable doubt
on page
46 lines 16 – 18.
The hospital patient medical record was presented as evidence and it
showed that this patient was seen and examined by a Cardiologist from San
Francisco, CA. This is Perjury.
3. Crime
No. 20 is
Subornation of Perjury ( as defined above ).
Dr. Frederick Lowe is a California – licensed physician. His specialty is Internal Medicine. Dr. Lowe allowed his testimony to be
presented by Dr. Philbin at the Judicial
Hearing. The testimony or declaration of
Dr. Lowe was presented by Dr. Philbin under oath, on the witness stand. This is located on page
44 line 10 : “ Cardiology Consultation would be very
advisable.”
On
page 48 lines
3 – 12 the hospital patient
medical record was presented as evidence.
The hospital patient medical record showed that the patient was seen by
the Cardiologist.
4. On
page 48 lines
22 – 24 : Attorney Schnier said : “ If the patient was seen by a Cardiologist
in Consultation , then we’ll withdraw the criticism ( charge ) of the hospital.”
That is like the mentality of a
seven year old boy. The accusation or charge that was made
against me was legal. It took six months
for the Hospital and Medical Executive Committee and Attorney
Schnier to prepare for this charge against me.
This was presented under oath , on the
witness stand , during the Judicial Review Hearing, and witnessed by nine ( 9 )
California – licensed practicing physicians.
When it was proven beyond any reasonable
doubt that their accusation against me was a misrepresentation of fact , an
intentional deception and a perversion of Truth , Mr. Schnier simply says
: we are withdrawing the accusation
against Dr. Lino Dial.
But
they already committed crimes against me !! The hospital and Medical Staff removed my job
without cause ; they removed my hospital
privileges without reason. That is
most unfair !!
This is
crime of fraud or Intentional Deception No.

THIS IS HOW DR. BRANT
COMMITTED HIS CRIMES.

55 : Dr.
Brant presented the hospitalization of Mrs. S.P. , 59 yr. old.
4. On
page 55 lines
11 – 13 : Mr. Schnier declares : “
So this would be a case or a
hospitalization which occurred before the formal Monitoring Program began.” ( Any time before could mean
50 – 100 years ).
5. Crime of fraud or
misrepresentation of fact No.

This patient died about a year before the
formal hospital monitoring program ( for Dr. Dial ) began.
Question :
How
could she be
hospitalized during the hospital
investigation of Dr. Dial ?
She was already
dead !!

Schnier claimed that this patient was reviewed by a Monitor.
The evidence : Page
55 line 17 : “ This was reviewed by a monitor.”
Question :
How
could this patient
be monitored by
a doctor ? She
was not even
in the hospital
!! She had been dead and buried
in the cemetery for about a year !!
7. Crime
of fraud or
Perversion of Truth

Attorney
Schnier said that this patient
had a monitoring ( medical ) report submitted by a doctor. That
report is definitely
a fraud.
8. Page
61 line 6
: “ We’ve talked about a monitoring period …this case was in the hospital and
died before the
monitoring began …” and
yet Mr. Schnier and Dr. Brant
talk about or speak of monitoring reports.
9. Page
66 lines 9 – 10 :
Mr. Schnier said : “ During the monitoring program each
and every hospitalization was
reviewed .” This is
crime of fraud
or Wrongful Criminal

because I have a
list of sixteen ( 16 ) patients who were admitted to
the hospital during the monitoring period but were not reviewed.
Attorney

DECLARED IN WRITING ;
No crimes
committed by hospital and doctors in the
City of Vallejo, California , so No prosecution was done.
The evidence :
I
have many copies
of the letter
to me from
the California Medical
Board stating that
no crime was
committed by the Hospital and
Doctors.

Evidence :
I posted on the World Wide
Web the list of the crimes committed by Hospital and Doctors in the City of
Vallejo, California 94589. I made these into two volumes:

Originally I counted 53 crimes.
After adding the crimes of Perjury and Conspiracy, the total is now
: 69
crimes. Still this does not
include Obstruction of Justice , and Violation of my Civil rights, Judicial Misconduct,
Prosecutorial Misconduct, etc.
III REQUESTS
FOR CRIMINAL ACTION :
Numerous requests for Criminal
Action at the County, State and Federal levels.
